Dog Bites in California

Even well-behaved dogs can sometimes bite people and cause serious injury. Because people are always at risk, California has a law that makes dog owners liable for all of the harm caused by their biting dogs. This is called strict liability. If you have been bitten by someone else’s dog, you do not even have to prove that the dog owner was negligent or that the owner knew about the dog’s vicious tendencies.

However, the owner might not be liable if you were trespassing or provoking the dog. Also if the injuries come from being knocked down by the dog rather than bitten, you will probably have to prove that the dog owner was negligent.

What can you recover from a Dog Owner?

A dog owner is responsible for all of the harms and losses caused by the dog bite. However, you can only recover compensation if there is evidence showing what you have lost. Here are some of the things that you can be compensated for.

  • Medical Bills
  • Lost income if your injuries prevent you from working
  • Future Medical Care
  • Value of household services (the things that you couldn’t do around the house because of your injury).
  • Physical Pain
  • Emotional suffering
  • Disfigurement
  • Humiliation
  • Fear
  • Anxiety
  • Loss of things you enjoy in life
